Conflicts with Idaho Homeowner's Associations

If you have purchased property in a development, it is likely you will be living under the rules of a homeowner's association. A homeowner's association has the authority to enforce covenants, conditions, and restrictions (CC&Rs) and to manage the common amenities of the development.

CC&Rs can be very restrictive. They can include rules about the number of vehicles you can park on the street, the number of pets you can have, and the amount of property maintenance you are responsible for. They also contain policies to govern themselves regarding election and removal of officers and annual meetings.

Disputes with homeowner's associations are not uncommon. Conflicts can arise with directors, amendments to and enforcement of CC&Rs, and the collection of homeowner's fees.
